Competition law

Prohibited agreements/Dominance/Mergers

We focus on the following aspects of competition law:

  • notifying national competition authorities and the European Commission of concentrations,
  • coordinating notifications of concentrations in multi-jurisdictional matters,
  • representing clients before national competition authorities and the European Commission in investigations into cartel agreements, vertical agreements and abuses of dominant position,
  • assisting clients in the event of dawn raids by national competition authorities and the European Commission,
  • preparing and submitting complaints to national competition authorities and the European Commission about the anti-competitive conduct of third parties and subsequently representing the complainant,
  • representing clients before national courts regarding private enforcement actions,
  • representing clients before national courts and the European Court of Justice in proceedings for legal remedies,
  • preparing compliance programmes for undertakings, carrying out compliance training and conducting compliance investigations.
State aid

Our legal advice in connection with state aid includes:

Significant buying power/Inadequate conditions in business relationships

We offer comprehensive legal advice in relation to the Czech Act on Significant Buying Power and the Slovak Act on Inadequate Conditions in Business Relationships, including:

  • representing clients before national authorities in relation to investigations into any alleged breach of the acts,
  • assisting in the event of dawn raids by national authorities for any alleged breach of the acts,
  • preparing and submitting complaints about any breach of the acts to national authorities and subsequently representing the complainant,
  • representing clients before the courts in connection with private enforcement of claims under the acts,
  • representing clients before national courts in proceedings for legal remedies.

Regulatory matters

We also focus on legal advice in regulatory matters, especially in relation to energy. We offer:

  • comprehensive legal analysis of regulatory questions,
  • representation before administrative bodies,
  • representation in proceedings before regulatory authorities and courts.

Public procurement

We provide complete advice both to public contractors and the tenderers, primarily:

  • providing legal analysis and assessment, and identifying and developing a suitable structure for a public tender,
  • realizing and administering public tenders, including preparing all tendering and contractual documentation,
  • carrying out legal analysis of implemented public tenders, representing public tenderers before supervisory bodies (the Office for the Protection of Competition in the Czech Republic and the Office of Public Procurement in the Slovak Republic),
  • representing tenderers by submitting objections to the public contractors and supervisory bodies (the Office for the Protection of Competition in the Czech Republic and the Office of Public Procurement in the Slovak Republic),
  • representing clients before national courts in proceedings for legal remedies,
  • carrying out training in public procurement procedures and practice.

Compliance
